My manager surprised me today saying that I was promoted yesterday from a programmer analyst to a systems analyst. I have an approved i-140 and have filed my 485. My priority date for EB3 is current. I also have a 3 year extension of H1B.
There is no change in the job responsibilities.
Question:
1. How soon should I file my AC21 request?
2. What is the impact of this promotion on my H1B?
3. I have waited for 7 years and I may be close to getting my Green Card. How does the AC 21 impact my pending 485?

You are *not* required to file AC21. Even if you do, in your case, it should present no problems at all, as your role & responsiblities have hardly changed.
It is not a wise approach to deny a promotion when you are not clear about the law. First be clear on the law and then make such important decisions.

1. Were n't you concerned with the security of this country. Have one more Id in your wallet. How does it matter? You are ready to do whatever this country asks you just because you are a non-immigrant.
2. Again I don't get your reasoning. How does immigration status verification ensure the security of this country ? Come up with some logical points.
Do you know that there are citizens from terror breeding countries roaming around in this country as citizens ( because they are not subject to country quota), whereas people from democratic countries like India being subject to all kinds of discrimination just because we are non-immigrants ( indirectly because we are subject to country cap) ?
It took a Martin Luther King to liberate blacks from slavery.
It took Mahatma Gandhi to get Independence for millions of Indians.
I am not assuming all individuals will have the same level of dignity and self respect. If you lack enough self respect, you will probably say US can ask us to wear a chain around our neck just because we are non-immigrants.

The end of the year is fast approaching and although we hear every other day that Nancy Pelosi or Zoe Loefgren is going to unveil something , nothing seems to happen . Only letters are flying back and forth each day from Governers and Tech industry representatives , but there seems to be no action . I prefectly agree with the fact that people are getting a bit overly impatient on the issues here , but I who has been patiently waiting and waiting and working with the state chapters just see a lull and silence on the immigration front ( Skilled and Unskilled ) . No one wants to talk about it or do anything about it on the Hill.Please prove me wrong here , I WANT TO BE WRONG !!!

Here is another part of story.
My PD was current back in 2004, this attorney/employer ignored my calls/emails from Oct to Dec 15. They filed my 485 during christmas week end, they screwed up something and USCIS rejected my application (thats what they say). Thanks to retrogession from Jan 2005. All my documents were ready by Oct. I would have had my EAD since 2005.
De javu, again I am being mandated to file thru same attorney. I don't have problem paying more money for a good attorney and good service.
I don't know if I am in a trap or something.

E-filed, Texas Service center and sent in supporting docs.
No emails or anything so far... Should i wait the whole 90 days before starting to make some noises?
I filed my EAD on the same date at Nebraska recieved that last week.
I just cannot understand why they need to do this filing and can't make EAD/AP a single doc and valid for two years.. Just plain frustrated. :mad:

Lou Dobbs Sucks. Please stop his false propaganda on H1B. Get your facts right. Know the program before you talk about it. H1B is given for 3 years and have an option to extension for every 3 years. Nobody is overstaying their visas. They are extending their visa.

One minor side effect is that India EB dates might further retrogress because still there a lot of folks with PD 2001,2002 etc pending namecheck clearance.

Isn't valid/unexpired I-94 counts as legal status not the approval notice. Also what if the employee takes a un-paid leave of absence due to health reasons etc.
I am sure so many in the same boat. Is there anything we could do?
She would still need to be on the Payroll and reported as an employee, preferable from the date of COS, If making a case of vacation or medical leave.
