I am not the one who is arguing for the sake of it. You are. So far I haven't seen any "in depth" logical reasoning from you. I am not replying anymore to your arguments unless you come up with some real logic.

There are things that can be measured in single dimension say on x-axis. Say you have to buy a car and you have to ask yourself a question – which car do I like to buy? Say you like Honda as compared to other cars. Your likeability of Honda or such cars could be measured on the positive side of the x-axis and likewise, if you don’t like some car, that can be measured on the negative side on the x-axis. Now, there could be another dimension to the situation, say, what is the car model in question, if it is a civic or maybe accord, accord, CRV, Odyssey, Element or whatever. Now if you ask yourself that question again – which car do I like? This time you need two dimensions to answer the question which Honda model you like and which you don’t like. Foe the sake of clarity you can do this on the X&Y-axis. But say if there is a choice of multiple colors. The reason I say all this is, I have fundamental difference with the folks who do not like reputation system but continue to look at it and complain about it, even when they have the choice not to look at the reputation system. And I do not have anything against you or anyone else, I am sure you are a good man with a kind heart.

my lawyers filed for AOS (for my wife and me) on july 2nd in NSC. still dont have any reciepts/ead/ap etc. i have no idea why. my i-140 was approved in TSC. i was hoping that i'd get the reciepts since everyone seems to be getting them!

Its a good thing, hope this will lessen the abuse of the visas by these Indian companies. As I mentioned in another thread, I have seen that H1 and L1s who come from India dont get a very good salary. Not good.
I think they have to pay the minimum wage as declared in their petition.
But I doubt whether they even send those employees on assignments. I guess they process these H1s as a carrot to retain the employees or to preprepared for any future assignments (they may not even come and the visas are never used)...
Wish there is a different category of visas for outsourced kind of work so that H1s can be used by America based companies and H1 is not seen in such a bad light.

Just suck it up and go for it. It seems unfair but that is a fact of life. Think about what is 5K in 5-10 years time, once u get GC you and ur wife can get better paid jobs and make up for it.

My employer's attorney is charging me outrageous fees of around $5000 to
apply for 485, AP and EAD for me and my spouse. This excludes USCIS fees. I work on hourly basis, so I should be taking care of immigration fees. My employer is not allowing me to file through another law firm.
Do I have any other options. How much do they charge usually.

For ex. current employer is paying 80K and new employer is going to pay 120 K. Which is way beyond the limit. In this case can new employer pay the difference in per diem.

It may be ok if the new employers writes in the employment verification letter sent to USCIS to reply to the RFE that your salary with the new employer is say between 80K-83K "plus benefits". Per diem is actually a benefit. The only problem could be, per diem is for finite period of time and you have to maintain a primary residence different than the place of your work, now sure though. I think this question could be verified by a lawyer and/or HR dept.

We have received information that the Comprehensive Immigration Bill will be voted soon and the bill will be closed for amendments on Wednesday. That leaves only 2 working days to get something done
The text for the bill was only released in the evening on March 28th
As you have seen from the document released by IV that H2A workers will now be able to get citizenship in 11 years and self petition themselves. But legal skilled workers
1) will not be able to self petition
2) the wait to citizenship as it stands today is definitely more than 11 years
3) and all the left-over visas from EB1, EB2 and EB3 will now go to EB5 category
We really need to make sure that everyone is aware of the unfair treatment meted out to legal skilled immigrants and will be doing the following
1) We will be putting up webfaxes to send to senators asking for similar treatment to legal skilled immigrants too. They should be up by 5.00 PM EST. Make sure you login and send a webfax ASAP.
How can I send the fax?
a) Login,
b) click on the 'Home' link on the top of the page,
c) then click on the 'WebFax' link on the left hand side menu options,
d) enter your information,
e) Select webfax # 10 and #11 and your state
f) Send the fax
2) We need to contact each and every company like Microsoft/Intel (and any other to which IV members belong) that depends on skilled immigrants for their functioning. We need to make sure that their HR and CEO know about this.
a) If you are not comfortable with speaking about this to your HR/CEO (and we don't see any reason why), please send us the email id of the right person in HR and your CEO. We will not put your name anywhere but send a polite email to them on behalf of Immigration Voice. We will NOT spam them (just a single email) and will not name any person in the email. Remember that this is just to get their attention so that they can do the right thing.

Thanks for the AC21 letter format. What do u mean 6yrs - minus remaining time? So, lets say, I'm in the 5th yr of my H1B. So the remaining time is obviously 1 year. My 485 is pending. So, will I get an extension of 6-1 = 5 yrs of H1 extension???:o If so...that wud be gr8. Pls emphasise on what u mean by that calculation.
I mean to say 6yr - used time (if you are in 5th year) then it is
6 - 5 = 1 yr remaining. (if 485 applied and you still have 140 approved - you still get only 1 yr ext)
