I guess since no one wants to do anything about their situation - we can all sit back and wait for another 4-5 years and hope that we get a green card at that time since that is the amount of time it is going to take most of us if nothing was to change in the current process. For all Eb3s along with EB2s with PD after April 2005, the movement in the coming visa bulletins wont be much encoraging unless the new Obama government does something significant about employent based category or immigrationvoice does a fruitful lobbying. The doings of something by obama government to employment based category is not in our hands. The only thing we could do is to help IV and help ourrselves by contributing to it to reach its financial target for better lobbying. Many states are "employment at will" states. This includes NY. You can say good bye that day and not turn up again (works both ways). Did you have leave owing and thus were simply using up paid leave before leaving him. If you did not sign a no-compete he doesn't have a leg to stand on, and even if you did no-compete contracts are often unenforceable because they go too far.
If you left without telling him and continued to draw salary that could be a problem.
If you are working for a customer that he still does business with, then speak with your managers. If you have a good relationship there the managers may put pressure on him -- like threaten to cancel his remaining contracts.
IRS explains in their FAQ what to do if you cannot get W2 (linked to earlier in this thread I think). DO NOT PAY A PENNY FOR IT! Do not accept an incorrect W2 either!
Better still go to a local IRS office and get advice. If you get a helpful IRS customer service rep, then ask to call your employer on a speaker phone with them present, imagine what IRS might do to him if they hear him on the phone attempting to blackmail you! I hear major audit coming! Or ask IRS to phone him there and then on your behalf, so they can ask for the W2 to be sent. If he dares tell them he won't send it he will find himself in a world of pain. The IRS do have a procedure, so they will likely send a demanding letter, woe is he who ignores such a letter.
Personally I would rather pick an argument with a police officer than an IRS representative. IRS has much more power put him in a world of pain than any other agency.
Customer service people are humans too, and I've found IRS customer service helpful before, be polite and they will advice they are going to hate the idea of someone being blackmailed for a W2, you might even "make their day".

Firstly thanks for the great show at DC, we are really beginning to bring this issue to the fore front. I could not attend myself but I did make a small contribution as a token of my support. However we should capitalize on the momentum and follow this up with some thing more substantial so that every one knows that this was not a one off spark but is a clear growing fire.
I guess (just by reading posts on IV) one point which came out pretty clearly was that IV has good support in some regions and really very little support in some others (support as in visible support, where people are willing to show up for rallies, contribute to IV�s efforts etc), I guess this pretty much means that we need to focus on building the regional chapters of IV, like have strong/formal leadership and goals of each of the chapters.
I was also thinking that we can possibly learn a lot from the protests by undocumented immigrants. They had record turnouts in their rallies and most of their people stayed away from work to take part in the efforts when ever there was a call for the same.
I thought which keeps hitting me is about a simultaneous rally in all major US cities? I know that undocumented immigrants did this and that really worked for them and once again this will build our regional chapters coz the onus will clearly be on each of the regional chapters to achieve targets (target in terms of membership, turnout in rallies, fund raisings etc ) set by IV
Some of the advantages of having simultaneous local rallies is that
1) No travel expenses � (So that we can spend more money on media and lobbying than travel expenses)
2) No need to time spent on travel � ( Better turnouts)
3) Comfort � every one can just go to a local rally point (Better turnouts)
4) Stronger regional chapters � (work at grass root levels)
Also if this can be done on a Saturday then I am sure the turn out will be much better.

Hi everyone, just had an AC-21 question which I was hoping you could help with.
I went to the OneNet link to get the job categories but wanted to get a second opinion.
My current role is computer systems analyst (business analyst) and i might move to a IT project managment role under AC21. There are definitely crossover similarities in both, of course the PM role has more of a leadership aspect to it.
The catagory in Onenet is 11-3021.00 Computer and Information Systems Managers for Project Managers; and 15-1051.00 Computer Systems Analysts for my current role. It shows they are indirectly related throught the Computer Programmer category i.e. 15-1021.00 Computer Programmers.
Is this acceptable for AC21? Please advise.
