Thanks for the good work. However, I saw a major potential flaw in estimating the applications from ROW. The report finds the life cycle for a ROWer to submit 485 is 1 year, thus assuming little AOS applications will be filed in the coming year from ROW. But this analysis forgot to consider those ROWers who started GC in year 2008. A person who started working in 11/2008 is ready to submit 485 now and uses one quota, even if a person who just started working won't be able to submit AOS till a year from now. With this under consideration, I feel the spillover will be much less than initially estimated.
Please correct me if I missed anything.

Sure, why not. An immigrant who is not in valid status is one who is legally not allowed to be in the country. Therefore he is a security threat. If somebody who should not be allowed in your house were in your house, you would consider him to be a security threat, wouldn't you? Am I missing something here?

I am working in tech field doing techie stuff (like System.out.println ;)) I did PMP in Jan 2008.. so far i didnt get a chance to use my PM skills (thanks to USCIS for not giving me GC yet and limiting my ability to look for better job)
I havent done MBA so I did learn few (project) management lessons while preparing for PMP.. although I wouldnt say that real world project management generally follows what is published by PMI
For studying PMP, I would highly recommend reading PMP Prep book by Rita Mulcahy.. I never read PMBOK... Also, give few mock up exams (there are plenty available on net)...
I am preparing for CFA level 1.. and man PMP was much easier! (just comparing one certification to the other - one with 5 books to read and other with only 1 book!)

HI ..most the CP filers are in US and contribute to Immigration Voice regularly. You can say by mistake or something else some people chose to go for Consular Processing when dates became current and they all are in bad shape at this time. If you think about those who applied for Cp being in US then you would realise 485 filers are too much priviledged in comparison of them.

Hi,
I am joining new job using AC21 provision coming monday. My new employer does not provide medical insurance for the first month. I am eligible for after I complete 1 month.
So my question is: till the time I get medical coverage from new employer (approx. 20 - 30 days), can I invoke COBRA? I heard that one can not invoke COBRA if he or she is employed (only meant for un-employement) is this true?
Also, should I call my current insurance company for COBRA now, or I can wait if I really need to visit a doctor? is there a grace period for this? Because there is a possiblity that I may never would have to visit a doctor for next 20-30 days, but who knows!

Your case is a bit different, I am not sure if you could avoid paying back as GC process is for your benefit so a company could request a pay-back, even though amount is a bit high and you did not get anything in return. I would compare it to a situation where company gives an employee a laptop and expect person to return it when s/he leaves a company.
helloh1's clause is different - company receives benefits by training its employees so it's just plain wrong to request a pay back in that case.
So just forget about it and move on, we all make mistakes and here in the US those mistakes usually cost money.

My spouse is landing here on Aug 15. That leaves only one day to get medicals done. Any suggestions on how to handle this ? Can she skip skin test and take X-rays directly ?
For skin PPD test , you have to go back to Doctor after 24-72 hours to show the reaction.If nothing comes up its good , but incase you are positive then you will have to go for XRay , so obviously you need to plan for more than 1 day.

This I hope will convince more people to join and align themselves with IV's activities than going in their seperate ways.
Most of us will have ideas, but agreed with a consensus we should let IV Core decide on a set of activities and hopefully more members embrace it.
We can never control what anti's think or how immigrants are viewed etc. We ignore others and we fight for what we think is a just measure.
Look within ourselves than looking at others.
I hope more people embrace IV(monetarily, physically, morally) for us to be able to bring volume into our side of the arguments.

I tend to agree too that nothing will happen, too much talking, too much BS, but, I can only hope that the republicans know that they can loose the house control, so, maybe they will prefer to have something more conservative than nothing.

Eb3I may nudge forward a little bit. Sadly that won't be very helpful to most folks on this board. Visa recapture is the only thing that can help near term. In the interim, administrative fixes, rule clarifications, USCIS efficiencies in application processings, Data transparency, though not glamorous victories as say visa recapture. Nonetheless make the path somewhat more comfortable and predictable.
EB3ROW may move also.
The movement of EB2I will be quite revealing for me. If there is quarterly spillover(which under current rules should be the case) then we might see some forward movement or at the very minimum the dates should stay put. However if there is no quarterly spillover, then with the approvals in EB2 recently, they will be hard pressed not to move dates backward somewhat.

I think most of the money comes from businesses that employ these people to cut costs.

There are large organizations that support our cause too, especially IT. They played a big part in positive H1 reform. Not sure if they were approached or they work independently.

I am not sure if the PM and email from IV is working. I sent out 4-5 PM and emails to various members from MI and I have not got a single reply. Also I still have not got an email from Sanjay or Varsha. Also breddy2000's email also was not received.......I am not sure if something is down.

I filed I-140/1-485 concurrently July 4th. Got my EAD and AP. I-140/1-485 still pending. Is it true that you get FP notice only when your I-140 is approved?

I went thru COBRA for the last 2 months I tell you its a PAIN IN THE A##.
Yeah premiums are very high. due to some gross miscommuniation on the provider they cancelled my COBRA for december since they didnt recieve payment.
ONce you quit our current job, you will get within 7-10 days details from ur current insurance cpmpany or a third party administrator which ur company uses. They will also send a payment coupon. (not a discount coupon..).
I hope your new company is paying the COBRA reimbursements for you...if not there is a loop hole in COBRA taht you can use and NOT pay the payments since you will have grace period. HOWEVER please keep in mind that the new insurance with your new company may have some restrictions on pre existing conditions...so keep an eye on that..since its for 30 days you will get on to a new insurance personally I wouldnt care for CBORA if the premiums are too high, why becuase, remember the coverage is RETROACTIVE, so you can get a claim reimbursed later after within the grace period

Its a good thing, hope this will lessen the abuse of the visas by these Indian companies. As I mentioned in another thread, I have seen that H1 and L1s who come from India dont get a very good salary. Not good.
I think they have to pay the minimum wage as declared in their petition.
But I doubt whether they even send those employees on assignments. I guess they process these H1s as a carrot to retain the employees or to preprepared for any future assignments (they may not even come and the visas are never used)...

Why don't we educate him by sending mails in writing to all the other news media organization's on a particular day - just like we did the flower campaign. Its costs less than a dollar and we can 1000's of them.

He responded at length claiming the he has no disrespect or disregard for India, just that he cares about his country so much that relatively it might make the other country look worse off!

- Are racially insensitive, slanderous to an entire community; with the risk of flaming hate crime (which is criminal offence)
- How they ignore the basic economic reality of high skilled labor's contribution and competitive advantage to the US economy and corporations
- How they ignore the basic legal reality that high skilled labor on H1B visas pay taxes, social security and medicare that goes back to the US economy
- How they tarnish the reputation of hardworking ambituous workers that are truly the only remaining link to the USA's hoary tradition of sweat equity with the hope of achieving the Great American Dream.
Basically, we need to point out that he is insulting his own country's grand traditions of democratic, legal and meritrocratic traditions by taking potshots at a defenseless community of white collar workers that are strengthening the social, economic and cultural fabric of this nation.
Of factual inaccuracy is his hallmark and his tradition. Let us counter that by reframing the context of the overall dialog so that the world see how shallow Lou Dobbs really is.

they have delayed processing time so more people will file for premium processing and they earn more money. H1b quota is not filling up and all of a sudden processing time went from 2 to 6-7 months in 1 month. Because so many people ( h1 - h4 ) might be travelling in dec - jan season. Come back in feb - march and processing time will be again 2 months.
ICPS printing problems , Delays in approving will happen even if they make premium - join me in this drive if your EAD Card approved and still waiting... we need more people... let the word spread ASAP.

I too thought that it could be a hoax call. But When I discussed with my employer and came to know the name of the person who called me is same as that of person who visited our employer 2 months back, then I realized that it is not a hoax call.
But I really don't understand what was the purpose and why I got such call and why he did not show up. Till now there is no communication from the officer.
